Te Terms of Service ("Terms", "ToS") regulują zasady korzystania z usług aiactaudit.pl świadczonych przez Piotr Reder ("Provider", "we", "us"). Korzystając z naszych usług, akceptujesz te warunki.
1. Service description
aiactaudit.pl świadczy EU AI Act compliance audit services dla EU SMB SaaS. Usługi obejmują:
- T1 Quick Audit — €799 single (founding rate, standard €1,499)
- T2 Audit + Quick-Fix — €1,999 single (founding, standard €3,999)
- T3 Continuous Monitoring — €299/mc (founding, standard €499/mc, 12-mc lock-in)
- T4 Studio Partner — €699/mc (founding, standard €1,499/mc, 12-mc lock-in)

Audit jest informational i NIE stanowi legal advice.
Klasyfikacja AI systems pod EU AI Act i recommendations są oparte na publicly available regulatory texts oraz informacjach dostarczonych przez klienta. Final compliance determination wymaga review przez qualified EU AI Act counsel.
Provider NIE jest prawnikiem i NIE świadczy legal services. Provider NIE gwarantuje że klient będzie compliant z EU AI Act ani że nie otrzyma penalty. Klient jest solely responsible za legal compliance.
Każdy audit report zawiera mandatory legal disclaimer reproducing this language.
3. Money-back guarantee
30-day money-back guarantee — no questions asked. Jeśli w ciągu 30 dni od purchase NIE jesteś zadowolony z audit, otrzymasz pełny refund przelewem bankowym (IBAN) lub Stripe (jak płaciłeś).
Refund procedure:
- Email do piotr@pricora.eu z subject "Refund request"
- Podaj order ID + krótki powód (opcjonalnie)
- Refund w 5-10 dni roboczych
Wyjątek: jeśli klient WYKORZYSTAŁ audit raport żeby uzyskać benefit (np. pokazał inwestorowi, użył w due diligence) i potem żąda refund — Provider zachowuje prawo do partial refund (20-50%) zależnie od circumstances.
4. Delivery time
Standard delivery: 5-7 dni od purchase. Workflow:
- Day 1: purchase + intake form (Twoje dane o AI stack)
- Day 2-4: audit + Claude skill execution + manual review
- Day 5: legal review by external counsel (post-finalization 05.2026)
- Day 5-7: PDF delivery + Loom video walkthrough (5-10 min, async)
Peak periods (Q3 2026 enforcement deadline rush) — delivery może wydłużyć się do 10 dni. Proactive communication w razie delays.
5. Pricing & payment
- Currency: EUR (€)
- Payment processor: Stripe (SCA-compliant)
- VAT: Provider jest autónomo ES — VAT zgodnie z hiszpańskimi przepisami. Reverse charge dla B2B w UE (Article 196 VAT Directive) — klient odlicza VAT we własnym kraju.
- Subscriptions (T3/T4): 12-month lock-in dla founding rate. Po 12 mc = możliwość cancellation w 30 dni notice. Standard rate (post-founding) = miesięczny rolling.
6. Founding Customer terms
"Founding rate" pricing limited to first 10 customers. Po wyczerpaniu = standard pricing (T1 €1,499 / T2 €3,999 / T3 €499/mc / T4 €1,499/mc).
Founding customers:
- Lock-in 12 mc dla T3/T4 (subscription)
- Discount preserved przez cały lock-in period
- Po 12 mc: opt-in renewal at founding rate, lub upgrade do standard, lub cancel
7. Confidentiality
Provider zobowiązuje się do confidentiality wszystkich informacji o kliencie i jego AI systems:
- Audit reports = client property + confidential
- NIE używamy w marketing bez explicit consent
- NIE sharing z third parties poza essential processors (Stripe, Resend, Anthropic)
- Anthropic Claude usage: anonymized inputs (no client identifiers)
- Client may request NDA — provided na request
8. Intellectual property
- Audit report = client property (po payment). Klient może używać internally + dla compliance purposes.
- Methodology, frameworks, decision trees = Provider's IP. Client cannot resell or replicate methodology.
- Sample report templates na stronie = Provider's IP, illustrative only.
9. Limitation of liability
Provider's liability is limited to amount paid by client w ostatnich 12 mc.
Provider NIE jest liable za:
- Penalty / fines nałożone przez regulators (klient odpowiedzialny za compliance)
- Indirect / consequential damages (lost revenue, lost opportunities)
- Decisions klienta podjęte na podstawie audit recommendations
- Changes in EU AI Act regulations po delivery audit (handled przez T3 Continuous Monitoring tier)
Limitation NIE applies do:
- Gross negligence or willful misconduct (limit = unlimited)
- Fraud (limit = unlimited)
- Personal injury / death (jeśli applicable)
10. Termination
Klient może terminate:
- Single audit purchases (T1, T2): money-back w 30 dni
- Subscriptions (T3, T4): 30-day notice po lock-in period
Provider może terminate:
- Klient narusza ToS (np. payment fraud, illegal use)
- Klient żąda audit dla unacceptable risk AI (banned use cases)
- Konflikt interesów (np. klient = direct competitor Provider)
11. Governing law & jurisdiction
Governing law: Hiszpania (gdzie Provider jest autónomo).
Jurisdiction: Sądy w Maladze, Hiszpania.
Konsumenci EU mają prawo do consumer protection w swoim kraju zamieszkania (regardless of governing law clause).
12. EU consumer rights (jeśli applicable)
Jeśli klient = consumer (NIE business) z EU, ma prawo do 14-day cooldown per Consumer Rights Directive 2011/83/EU. ALE: digital services performed before cooldown = klient zrzeka się prawa odstąpienia (Art. 16(m) CRD) gdy explicit agrees.
Note: Audit services standardowo świadczone B2B (klient = business). B2C rzadkie ale możliwe.
13. Changes to ToS
Provider może zaktualizować ToS. Klienci notified via email 30 dni przed effective date. Active subscriptions = grandfathered na old terms do końca lock-in period.
